The Sale of Alcoholic Beverages Überoom, LLC does not sell alcohol to minors (anyone under the age of 21 years old). By purchasing alcoholic beverages from Überoom you affirm and swear that you are over the age of 21 and agree to accept responsibility for your own purchases and actions. Once wine is shipped, age verified and delivered by courier, you accept responsibility for your product and acknowledge that the product is wholly and entirely under your control. In the event that a minor has accessed and utilized the uberoom.com website to purchase alcoholic beverages, we are required and obligated to inform enforcement officials in your local area to prevent any future damage. All alcoholic beverage purchases must be age verified upon release by courier. Parental Control Protections In accordance with the Communications Decency Act of 1996, Überoom, LLC hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are readily available that will assist you in limiting access to Content that may be harmful to minors. These software companies are CyberPatrol, NetNanny, SurfWatch, and GuardOne. Überoom, LLC is not a partner, nor do we assume any relationship with any of these companies or their services. Release of Liability and Indemnification “Überoom Package” means the self contained package prepared by Überoom, LLC and sold to you or your customer to enhance the room experience. Third Party Content and Monitoring Any opinions, statements, services, suggestions, events or other information or content expressed verbally or written and made available on uberoom.com by third parties (including information providers, users and advertisers) are those of the respective author(s), distributor(s), or publisher(s) and not of Überoom.com. Überoom, LLC does not endorse, nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on uberoom.com websites or by a Überoom, LLC sales representative. For questions or concerns arising from published information, please contact us. Gift Certificates Gift certificates are redeemable via our online store at www.uberoom.com and can be applied to all or any specific range of products. Due to the limited availability of certain products, some products may not be applied to gift certificate redemptions. Gift certificates are not redeemable for cash and cannot be exchanged, extended or returned for a refund, except to the extent required by law. Gift certificates are non-transferable and have an expiration term which cannot be extended (again unless applied by law). In the event that your order balance exceeds your gift certificate value, you must first pay the balance with a credit card to redeem the certificate. Gift certificates have no cash value and are not considered legal tender. Gift certificates are subject to the Überoom, LLC Terms and Conditions and Privacy Policy. We are not responsible for expired, lost and/or stolen gift certificates. Überoom, LLC reserves the right to void and cancel any purchase deemed to be ordered with a fraudulently obtained gift certificate. Überoom, LLC is under no obligation to inform customers that their gift certificate is approaching expiration. All gift certificates are issued and monitored by Überoom, LLC. Purchaser hereby agrees that he/she is of age in their state to purchase and consume any alcoholic beverages. He/she agrees that the credit card, cashier’s check, and/or money order used to purchase this order are owned/established by the purchaser. Überoom, LLC and its affiliates are not liable for identify fraud or the misrepresentation of the purchaser. Any identity fraud by the user may result in a felony in their state and the State of Texas. Identify fraud is not tolerated and will be punishable to the fullest extent of the law. These notices are to serve you with critical information regarding your orders, accounts or any urgent issue that would warrant such a message. Disclaimer of Warranties Überoom, LLC does its best to ensure that our information and products offered are of the most accurately recorded descriptions. We check our servers regularly to ensure that our code is free from spyware, malware, viruses, and/or any harmful occurrences that may provide an interruption in service of your computer. Use our site at your own risk. Due to the limited nature of our capabilities we do not accept responsibility for your hardware or service should there be any interruption or corruptions of data within your computer system, network or host provider. Limitation of Liability Uberoom.com is a theme decoration portal made to provide direct access to purchase our product offerings. In no way does Überoom, LLC or any of its affiliates accept responsibility for loss of data or downtime resulting in the lack of access to any specific product offerings. Account Termination Uberoom.com or any site operated by Überoom, LLC may be terminated or shut down in the event that we suspect or identify fraudulent activity or activity by a minor. Again, we reserve the right to refuse service and we reserve the right to obtain additional information including photo identification to ensure alcoholic beverages are going into the hands of responsible adults over the age of 21. Überoom, LLC guarantees the room to be set-up on the designated set-up day or we will refund the customer 100% of the total price. In the event of a delay on the day of the set-up, customers will be notified to the best of our and our hotel partner's abilities. This 100% On-Time Guarantee does not apply in the event of missing items, but only if the items included in the Überoom shipment is not set-up in the customer's room on the designated day. Items sometimes may be missing due to a lack of stock, and replacement items or appropriate reimbursement for individual items will be processed, but missing items and replacement items fail to create a failure of the 100% On-Time Guarantee. This event of missing or replacement items applies for all Überoom products as well as outside vendors or partners Überoom may use to fulfill the customer's order. Should the customer eventually choose to have their room decorated, this 100% On-Time Guarantee does not apply and no refund will be credited. In the event that we suspect fraudulent activity by customers and or hotel, B&B, or other hospitality employees or partners, Überoom, LLC has the right to investigate such claims to the fullest extent of the law. Guarantee does not apply if incorrect shipping address is provided. If fraudulent activity is suspected, proper authorities will be notified and any refund will be suspended at the sole discretion of the shareholders, employees, officers and directors. In the event an Überoom is not set-up on time due to what employees at Überoom, LLC deem to be by the fault of hotel, B&B, or other hospitality employees or partners, no commissions will be paid for that event. If a hotel, B&B, or other hospitality establishment does not set-up an Überoom on time, Überoom, LLC has the authority to not work with that establishment for future partnership benefits at the discretion of the shareholders, employees, officers and directors. The fee to redirect a package is $99.95. When a package is redirected there is no guarantee for an on time shipment, and the 100% On-Time Guarantee is no longer applicable. Return Policy Due to both the expensive nature of shipping last-minute and the perishable nature of our products, no returns are allowed once the package has shipped. When a set-up request is made, the customer acknowledges that hotel's responsibility for their items from the time of delivery and beyond. In the event items are missing or are not completely delivered to the customer's possession, it is the customer's responsibility for obtaining their items from the hotel. Light Bulbs Hospitality management and staff may install the light bulbs at their own discretion. We will ship them with every package, but management has the final say as to whether they desire to install them in their room's light bulb sockets. Force Majeure Überoom, LLC will always do its best to provide accurate information, excellent service and quality products and data. We shall not be held accountable from performance under this Terms and Conditions if uberoom.com is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement under the Terms and Conditions for any of the following reasons: (a) any provision of any present or future law or regulation or order of the United States of America, or any state thereof, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of Überoom, LLC or its affiliate partners. Agreement By using uberoom.com, user acknowledges that he/she has read the above statements and definitions, and hereby agrees that he/she has had sufficient time to read, understand and ask questions, if any, concerning the nature and scope of these Terms and Conditions and have been encouraged to consult an attorney if needed.
